Time-related claims, delay and disruption often account for significantly greater costs than any other disputes, including changed conditions direct costs. This program prepares attendees to control and/or mitigate risk when facing a Contractor’s potentially unsupported delay or disruption claim.

 

From studies and experience in scheduling and analysis, this presentation will describe symptoms of potential claims with the corresponding claims avoidance documentation that should be provided contemporaneously as the best support for negotiation or dispute resolution. It is always best to analyze and resolve time-related issues as quickly and as early in the life cycle of the impact event as possible, and the sooner the Owner starts collecting documentation, the better the case in the event of dispute.

 

Knowing what documentation is needed for each special case, and collecting it early, is better and more economical than having the best attorneys and consultants on board later. The contractor’s actions and lack of actions provide clues to situations that will likely result in a claim at a later date. With the knowledge in hand to foresee the claim, specific and topical data can be collected that improve the possibility of settlement and provide stronger defense for further dispute resolution efforts.

 

This presentation provides guidance for documentation needs based on the symptoms or signals from the contractor during the project that yield clues to upcoming claims, including a checklist and decision matrix for the CM to use.
