Empowering the Project Team to Successfully Avoid Claims

Presented by:
J. Scott Lowe, P.E., Principal
Trauner Consulting Services, Inc.

We all want to avoid claims, but too frequently our contract specifications and construction management practices actually work against us. The key to successful claims avoidance, once the project contract has been executed, is to provide the project team with the tools they need to identify problems quickly, measure impacts reliably, and price them fairly in order to resolve changes as they arise and, thus, avoid claims. Although many contracts are written to avoid claims, in reality, some contribute more to claims avoidance than others. Also, many widely used construction management approaches actually encourage claims. Both the contract and standard practices can operate like "claims generation machines."

This session will identify contract specifications and construction management practices that encourage claims. The speakers identify and discuss how these specifications and construction management practices, in real-life situations, can lead to the generation of claims.

This informative 90-minute program will:

  • Define changes and claims and show how and why claims arise
  • Identify specifications that encourage claims
  • Evaluate construction management practices and contract specifications that encourage claims
  • Explain best practices for claims avoidance
  • Identify use of “time and material” provisions to price changes
  • Show how to achieve success in spite of these specifications
  • Review construction management practices that encourage claims and avoid claims
  • And much, much more!

Who Will Benefit?

This presentation is a must if you’re a contractor, public or private owner, subcontractor, construction manager, owner’s representative, architect or other design professional writing contracts or providing project oversight services.
