Limitation of Liability Clause Shielded Architect


A limitation of liability clause in an architectural services agreement was a freely negotiated contractual allocation of risk. The clause was enforceable even though it had the effect of limiting the project owner’s remedy for an alleged $4.2 million loss to a refund of the $70,000 architectural fee.
