Subcontract Pay-When-Paid Clause Enforced in California


A payment clause in a subcontract was an enforceable pay-when-paid clause, not an unenforceable pay-if-paid clause. The timing of the prime contractor’s progress payments was justified. The contractor was not liable for statutory interest for late payment.
