Supplier's Documents Did Not Adequately Disclaim Delay Damages

An equipment supplier’s disclaimer of delay damages was found in a limitation of warranty clause. It applied to “equipment provided” and therefore did not apply to delay in providing equipment. A separate damage disclaimer on the reverse side of delivery tickets never became part of the agreement.
