Work Divided into Discrete Parts for Purposes of Default

A contract is severable when work assignments do not involve sequential, incremental or interdependent progression of construction at one contiguous site. When a contract is severable, the contractor’s performance at each separate site must be evaluated independently for purposes of a default termination.
