Owner Allowed to Sue Sub for Negligent Performance of Subcontract Work

A project owner was allowed to sue a subcontractor for property damage allegedly caused by negligent performance of the work while under contract to the owner’s prime contractor. The Texas Supreme Court said the sub owed the owner a duty of due care independent of its contractual undertaking.
