Contractor's Aggressive Pre-Trial Discovery Waived Arbitration Rights

A contractor, although a defendant in litigation, made extensive and aggressive use of the pre-trial discovery process. Shortly before trial date, the contractor for the first time invoked its contractual right to arbitration of disputes. By then, the contractor had waived its arbitration rights.
