Failure to Indemnify Was Separate Breach of Subcontract


A subcontractor’s promise to conform to the specifications was distinct from the promise to indemnify the prime contractor against losses caused by the sub’s defective work. The prime’s indemnification claim accrued at a separate (later) date from the original deviation from the specifications. The prime’s indemnification claim was not time barred by a statute of limitations.
