Federal Circuit Considers Government Breach of Good Faith

In order to breach the implied warranty of good faith and fair dealing, it is not necessary that the government target a specific contractual benefit for reappropriation. Government conduct that has the effect of reappropriating a benefit conferred under the contract is a breach of the implied warranty.
