Miller Act One-Year Filing Period Ruled Merely Procedural


The one-year claim filing limitation in the Miller Act is procedural, not jurisdictional, so a claimant can argue the period should be equitably extended. The claimant in this case, however, failed to establish that its tardiness was caused by other parties.
