State Guaranteed Payment to Subs When It Waived Payment Bond

When a state Department of Transportation elected to waive the payment bond requirement for a disadvantaged small business, the DOT became the payment guarantor for that contractor’s subcontractors. The DOT was liable to unpaid subcontractors even though the DOT would end up paying twice for the same work.
