Pending Civil Litigation Did Not Disqualify Offeror

An offeror had no duty to disclose a civil action pending against it in state court. There was no requirement in the solicitation to disclose the suit and agency evaluators were not expected to research state court filings. The offeror, which was contesting the allegations of the suit, was properly determined to be responsible.
