Assessment of Liquidated Damages Not a 'Continuing Claim'

A government claim for liquidated damages for late completion accrued upon the contractual completion deadline and had to be asserted within the six-year limitation period established in the Contract Disputes Act. Liquidated damages under a construction contract are not a “continuing claim” consisting of a series of distinct wrongs.
