Intentional Interference Ruled Exception to Delay Disclaimers in Texas


Active interference by a project owner is an exception to the enforceability of no-damage-for-delay clauses under Texas law. This rule applies to public project owners because a claim for breach of contract is authorized by the Texas Local Government Contract Claims Act. A dissenting opinion argued that the public project owner was protected by governmental immunity.
