Contractor Had No Obligation to Release Sub's Retainage

There had been no final acceptance by a public project owner even though the owner had released the prime contract balance to the contractor. The payment was secured by a bond posted by the contractor. Entitlement to the funds was in controversy and subject to pending arbitration. A subcontractor’s suit for its retainage was premature.
