Prime Contracts Directly with Lower-Tier Subcontractor of Defaulted Sub


Under the Default clause of a subcontract, the prime contractor was entitled to contract directly with a lower-tier subcontractor after the termination for default of the subcontractor. The defaulted sub was liable for the increased cost of completing its scope of work.
