Defective Performance Can't Be Raised after Convenience Termination


Once a contract has been terminated for the convenience of the government, the contractor is entitled to reimbursement of performance costs even if that performance was defective. Under the contract’s Material and Workmanship clause, contracting officer approval was not required for equipment used in the performance of the work. Approval was required only for equipment incorporated into the project.
