Construction Manager Recovers Equitable Adjustment to Fee

A construction management agreement called for, but did not define, an “equitable adjustment” to the fixed CM fee in the event of expansion of the project. An increase of 4.7 percent of construction cost was equitable because that figure was used to calculate the original fixed fee as well as one adjustment early in the project.
