Warranty Claim Against Contractor Not Barred by AIA Waiver

The AIA reciprocal waiver of claims for insured property damage to a project expired upon final payment to the contractor. A party that purchased the property subsequent to final payment was not bound by the waiver and could sue the contractor for breach of warranty.
