Lead Paint Particles Constituted Type II Differing Site Condition


Lead paint particles in excavated soil were a Type II differing site condition. The condition was unusual and could not have been reasonably anticipated. The differing condition prevented the contractor from disposing of stockpiled soil in the most economical fashion and increased the cost of contract performance.
