Contractor Did Not Waive 'Pay-if-Paid' Clause


Despite an earlier assurance of payment, a prime contractor did not waive the right to enforce a “pay-if-paid” clause against a subcontractor. The contractor repeatedly refused to make progress payments to the sub due to nonpayment by the project owner.
