Contractor Slipped Additional Work into Scope of Subcontract


When a contractor expanded the scope of work it had solicited, adding a work item to the written subcontract without bringing it to the attention of the subcontractor, the contractor committed constructive fraud. In light of that fraud, the written subcontract was altered to exclude the added work.
