Surety Not Bound by Settlement Arbitration

A Massachusetts court has ruled that although a surety may be bound by an arbitration clause in a contract incorporated by reference into the bond, a surety was not bound by the results of an arbitrated settlement. The surety was not a party to the settlement agreement that called for arbitration.
