Owner Fails to Honor Cure Period – Loses Bond Rights


A contractor was contractually entitled to 30 days to cure deficient work. Absent contractor fraud, the project owner was not allowed to ignore the cure period and summarily terminate for default. The owner was in breach of contract and could not bring a claim against the contractor’s performance bond.
