Differing Site Condition Claim Fails to Meet Standards


A contractor’s differing site condition claim failed to satisfy two of the four elements of a successful claim. The contract did not contain the affirmative representations alleged by the contractor, presenting only raw geotechnical data. The contractor then drew unreasonable inferences from that data when predicting the subsurface conditions it would encounter.
