Designer of Government Project Not Protected by Sovereign Immunity


A design professional that exercises discretion and control in its work for a governmental entity is not protected from third-party suits by the doctrine of sovereign immunity. Only independent contractors that work in strict accordance with government directives are entitled to immunity. A concurring opinion argued that even those contractors should not receive immunity.
