Outdated Boring Logs Produce Successful Site Claim

Test boring logs incorporated into the contract documents were obsolete. Conditions on an estuary floor changed prior to bid solicitation. The contractor conducted an adequate pre-bid site inspection and was entitled to recover for a Type I differing site condition.
