Surety's Fraudulent Inducement Claim Subject to Arbitration

A surety’s fraudulent inducement defense against a performance bond claim was subject to arbitration under the terms of the bonded contract even though a finding of fraud would render the bond, and the incorporation of the arbitration clause, void. Any challenge to the validity of the bond had to go to the arbitrator.
